Understanding CARES Eviction Processes and Procedures

This RentAlert is to assist CARES Act covered properties in understanding the differing eviction processes and procedures. PROPERTIES THAT ARE NOT COVERED BY THE CARES ACT SHOULD BE PROCESSING ALL EVICTIONS AS THEY ALWAYS HAVE DONE.

Needless to say, the CARES Act has substantially disrupted how evictions are handled. No one was certain how the CARES Act would operate once the eviction moratorium ended on July 26th. Some of the procedures for evictions in CARES-covered properties have shifted over the past month. At the same time, while the CARES Act has changed the guidelines on how some types of evictions are handled, it has not changed the process on other types of evictions. It is critical that landlords/owners are aware of the process and type of eviction being processed and be aware of the problems the Courts are creating for each type. Below is a summary of the different types of evictions that can be filed and the process now in place.
